Recently, on Monday, the governor of Tamil Nadu passed a bill that seeks to ban online gambling. This comes barely a day after the Center came out with novel rules on the issue of online gaming.
Last year, in the month of October, the state assembly passed the Tamil Nadu Prohibition of Online Gambling and Regulation of Online Gaming Ordinance, 2022. However, in March 2023, the governor RN Ravi returned the ordinance for reconsideration. The assembly later re-adopted the bill and then handed it over to the Raj Bhavan.
Tamil Nadu Laws on Online Gambling
The bill prohibits online gambling and gambling that is practiced for monetary gain. The scope even covers games in which both skill and chance are involved. Also included are games in which the element of chance is more than the element of skill. Additionally, games that involve the use of wheels, dice and cards are also included.
The state has also created the Tamil Nadu Online Gaming Authority. The Authority has the power to supervise online gambling companies in the state.
Center rules regarding online gaming
Very recently, the MeitY has notified some amendments to the Information Technology Rules, 2021. These amendments have clarified the regulations in the online gaming sector. The modifications thus made required the establishment of a myriad of self-regulatory bodies (JUR). Online games that include elements of money and gambling will need approval from these self-regulatory bodies. Additionally, it is worth noting that all games that have the element of risk in the outcome of events will be prohibited.
To make online gaming safer for everyone, the regulations require online gaming companies to complete a KYC procedure for their users at the time they make an initial deposit into the accounts to play the online game. The Reserve Bank of India has set several KYC norms and online gaming companies will have to comply with them.
The dispute between the Center and the State
Rajeev Chandrashekhar, Minister of State for Electronics and IT, clearly stated that ‘state governments’ supervising online gambling are no longer necessary after the notification of IT rules for online gaming.
A day after the notification of the revised IT rules, online gaming companies raised concerns in a meeting with MeitY over the passage of entire legislations by the state assembly that may not actually be in line with the norms given by the rules of the Center. According to MeitY, gambling is the responsibility of the State, however, all activities that occur on the Internet are the exclusive responsibility of its own domain. These activities also include gambling and online gambling.
