The Hindu Succession Act, 1956 does not clearly define ancestral property. The Supreme Court said that property inherited by a Hindu male from his father, paternal grandfather or paternal grandfather’s father is included in ancestral property.
Legal heirs of an ancestral property
An heir is defined as any person who is legally entitled to inherit the property or estate of his or her ancestors, who died without leaving a will. After the death of such owner, matters relating to the inheritance of the property and other claims shall be borne by his legal heirs.
