Right to Health Bill: Rajasthan became the first state to pass the Right to Health Bill, giving all residents of the state the right to avail free services at all health facilities public and private. However, the visionary move by the Rajasthan administration is facing a strong reaction from the opposition party as well as a section of doctors, demanding withdrawal of the legislation.

What is the bill on the right to health?
The Rajasthan Right to Health Bill was introduced in the Rajasthan Assembly in the year 2022. Its objective is to make provisions for the security and satisfaction of equal rights to health and well-being for all people. In simple words, if a patient cannot pay the expenses for emergency care, stabilization or referral, the government will reimburse the healthcare provider.
Key features of the Right to Health Bill are:
- The bill gives state residents the right to health and access to health care. It is about providing the inhabitants of the state with free medical services in any clinical center.
- The bill requires the state government to defend the right to health and maintain public health.
- Health authorities will be established at both the state and district levels. These organizations will create and run systems to manage public health emergencies and deliver high-quality healthcare.

What does the bill establish on the right to health?
- Right to health: Everyone will have free access to indoor and outdoor patient departments, medicines, tests at public health centers and emergency care and treatment at all health care providers without advance payment or police approval.
- Additional Rights for Residents: Ordinary residents of Rajasthan will have certain additional rights to free healthcare services at any clinical establishment and free transportation, treatment and road accident insurance coverage at all healthcare establishments.
- Obligations of the State Government: The State Government shall formulate and prescribe a public health model, make appropriate provisions in the State budget and make available health care services with due regard to distance, geographical area or population density. A human resources policy will also be created and legitimized by the administration to guarantee an equitable distribution of health professionals.
- Health Authorities: At the state and district level, separate organizations will be established under the names of State Health Authority (SHA) and District Health Authority (DHA), respectively. These authorities will develop, implement and monitor systems to manage public health emergencies and provide high-quality health care.
- Grievance Redressal: The Act provides a procedure to address complaints regarding withholding of services and violations of rights. To submit concerns, a 24-hour helpline and support website will be developed. Agencies, including the Local Health Authority and the State Health Authority, will be involved in cases of unresolved complaints.
Why are doctors opposing Rajasthan’s Right to Health Bill?
A large number of doctors are on the streets and called a strike to show their dissatisfaction with the new bill. Private healthcare providers have criticized the law, saying it ignores the advice of medical professionals, is ill-prepared and fails to take into account the practical realities of the system.
Furthermore, protesting doctors believe that the law overregulates the medical industry, as there are already many other bills facilitating free medical services. They consider the implementation of the bill to be an impractical approach to healthcare and a potential burden on private hospitals.
