What are the newly imposed restrictions on personal laptop/ computer imports? Why is the move taken?

In India, new restrictions have been imposed on imports of laptops, computers and handheld devices with immediate effect. On Thursday i.e. August 3, a notification was released. The Directorate General of Foreign Trade stated that imports of computers have actually been restricted, along with several other items falling under the seven categories of HSN code 8471. However, no restrictions will be applied to imports under the baggage rules.

The objective is to encourage the domestic manufacturing of said products that stops importing most of these items from China. Imports of personal computers and laptops have therefore been suspended.

The notification

According to the notification, all-in-one personal computers, laptops, ultra-small form factors, tablets, and servers that fall under HSN 8741 will be “restricted.” Its import would be allowed after obtaining a valid license applicable for the purposes of restricted imports.

Interestingly, the exemption from the obligation to obtain import licenses has been applied in the case of a tablet, a laptop, an ultra-small form factor computer or an all-in-one personal computer. This also includes those purchased on e-commerce portals through courier or postal mail. Imports will also come with the payment of rights as appropriate.

Exemptions have also been applied to tablets, ultra-small form factor computers, all-in-one personal computers and laptops for import licensing needs in case they are a major part of capital goods.

For research and development testing and evaluation repairs, the Government provides import license exemption for imports of up to 20 products per consignment. However, this exemption depends on the fact that such imports will not be allowed for sale but only for use for the aforementioned purpose. “Furthermore, after their intended use, the products would be destroyed to the point of being unusable or re-exported,” the notification said.

The notification also states that no license will be required for restricted imports in case of repair and return or reimport of repaired products abroad, in accordance with the Foreign Trade Policy.

The reason for the restrictions

The restrictions are seen as a direct strengthening of the production-linked incentive (PLI) scheme recently revamped by the IT Hardware Centre. According to a senior government official, this same move encourages companies to manufacture according to local demand in India, as the nation moves towards strengthening its domestic production in this sector.

It was in the month of May when the plan was revised with an expenditure of Rs 17,000 crore. This amount is more than double the budget of the same plan approved in 2021. This drives manufacturers of servers, personal computers and laptops to manufacture more, in a situation in which a significant part of the imports of these segments come from reality of China. .
